Public Offer Agreement of Boutique Cavalier Online Store

This Public Offer Agreement governs access and services provided via boutique-cavalier.com between the Online Store (“Seller”) and any individual who places an order (“Customer”).

1. General Provisions

1.1. This Agreement is a public offer (according to Articles 633, 641, and Chapter 63 of the Civil Code of Ukraine) and contains all the essential terms of the sale of goods remotely, i.e., through the Online Store.

1.2. In accordance with Article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the terms of this Agreement (acceptance) is the fact of placing and/or paying for an order under the conditions of this Agreement, in the manner and at the prices specified in the Online Store.

1.3. By entering into this Agreement, the Customer confirms that they are fully acquainted with and agree to its terms, and, if the Customer is an individual, give consent to the processing of their personal data in order to fulfill the conditions of this Agreement.

2. Definitions

Goods
Equestrian equipment, apparel, accessories, and products for riders, horses, stables, and dogs offered in the Online Store.
Online Store
A means of presenting or selling goods by electronic transaction.
Seller
The online store Boutique Cavalier.
Customer
An individual who places an order on the website and accepts the terms of this Agreement.
Order
The Customer’s choice of goods on the website, confirmed by placement and payment.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer ownership of the Goods to the Customer, and the Customer undertakes to pay for and accept the Goods under the terms of this Agreement.

3.2. This Agreement governs: the voluntary selection of Goods by the Customer; the independent placement of an Order by the Customer; payment for the Order; processing and delivery of the Order to the Customer.

4. Order Placement

4.1. The Customer may place an Order for any Goods available on the website.

4.2. In case the Goods are out of stock, the Seller shall notify the Customer by phone or email.

4.3. The Customer may replace the Goods, refuse them, or cancel the Order.

5. Payment Terms

5.1. Payment may be made as follows:

  • by bank card (VISA/MasterCard) at the time of placing the Order;
  • by cash on delivery at a Nova Poshta office (subject to a mandatory prepayment of 30% of the Order amount).

5.2. If funds are not received, the Seller reserves the right to cancel the Order.

6. Delivery Terms

6.1. Delivery is carried out throughout Ukraine via Nova Poshta.

6.2. The average delivery time is 5–7 business days.

6.3. Together with the Order, the Customer receives the necessary documents in accordance with the laws of Ukraine.

7. Rights and Obligations of the Parties

The Seller shall: deliver Goods of proper quality; ensure proper packaging and delivery; provide accurate information about the Goods.

The Seller has the right to: change prices and terms of the offer; cancel the Order in case of missing prepayment.

The Customer shall: provide truthful information when placing an Order; pay for the Order on time; accept the Goods.

The Customer has the right to: receive the ordered Goods; require the Seller to fulfill the terms of this Agreement.

8. Liability of the Parties

8.1. The Parties shall be liable in accordance with the laws of Ukraine.

8.2. The Seller is not liable for: minor differences in color shades of the Goods due to monitor settings; delays in delivery caused by the carrier; consequences resulting from incorrect data provided by the Customer.

9. Miscellaneous

9.1. The Seller has the right to change the terms of this Agreement by publishing a new version on the website.

9.2. Use of the website and placement of an Order means the Customer’s acceptance of the terms of this Agreement.

9.3. The Customer’s personal data are processed in accordance with the Law of Ukraine “On Personal Data Protection.”

10. Duration of the Agreement

10.1. This Agreement is considered concluded from the moment the Customer places or pays for the Order.

10.2. It remains in force until the Parties fully fulfill their obligations.
